Terms of sale

In the event of inconsistency or discrepancy between the French version and any of the other linguistic versions of this publication, the French language version shall prevail.

These General Terms and Conditions of Sale (hereinafter "GTCS") apply exclusively to current and future business relationships between

the "Site" www.mesfleursfr.com, represented by the trade name Mes Fleurs,

registered with the European Trade and Companies Register under number 101 627 974 R.C.S. Paris, with intra-Community VAT number FR33 101 627 974,

and

the "Customer," referring to any natural person making a purchase on the site.

Acceptance of Terms and Conditions of Sale

By confirming an order via the Site, the Customer accepts without reservation the entirety of these Terms and Conditions of Sale, as well as the prices and descriptions of the products available for purchase.

Mes Fleurs reserves the right to amend or modify these Terms and Conditions of Sale at any time. In the event of a modification, the version applicable to any order shall be the one displayed online on the Site at the time the order is placed.

Products and Services

The essential characteristics of the products and services are described on our Site using images and descriptive text, with the greatest possible accuracy.

However, the photographs are provided for illustrative purposes only and do not constitute a contractual commitment. Colors vary depending on the lighting; the use of natural materials means that no two products are exactly alike; and the handmade nature of the items also gives each product a unique character.

Prices

Within the EEC, product prices are quoted in euros (€), inclusive of all taxes (TTC) but excluding delivery charges. Prices include applicable VAT, and billing is based on the rates in effect at the time of the order, subject to availability.

For orders outside the EEC, prices are quoted exclusive of taxes (HT) and delivery charges. Customs duties and other taxes must be paid by the customer directly to the carrier.

Mes fleurs reserves the right to modify its prices at any time in response to economic or regulatory conditions. All prices are subject to correction in the event of obvious typographical errors.

Orders

Any order placed on the Site constitutes a firm commitment on the part of the Customer. A confirmation email will be sent to the Customer to acknowledge receipt of the order and to confirm that order preparation and delivery have been initiated.

In the event of a temporary stock shortage regarding one or more components of the ordered items, Mes Fleurs may replace an item with a very similar, equivalent variety, although certain characteristics may differ.

In the event of a permanent stock shortage, Mes Fleurs will take the initiative to deliver an equivalent item to the Customer—where possible—at no extra cost, or at a lower price if the product belongs to a lower category. If Mes Fleurs is unable to provide a substitute item, the Customer's account will be credited with the amount corresponding to the unavailable item.

We reserve the right to cancel any order from a Customer in the event of an existing dispute with the Customer or for any other legitimate reason. 

Payment

Payment for the order is due in full upon validation of the basket.

Accepted payment methods are by credit card (Visa, MasterCard), by Paypal and Applepay, via the secure Mollie system. In the latter case, the Customer's banking information is never communicated to Mes Fleurs, but processed directly by the bank's secure and encrypted server. In the event of refusal by the bank, the order will be automatically canceled.

Delivery

The items are delivered to the address indicated by the Customer when ordering.

The packages for prepared orders are delivered to the carrier chosen by the Customer, Colissimo or Chronopost. Delivery times are communicated by the carriers for information purposes only and may vary depending on the availability of the items and of the place of delivery.

Exceeding these deadlines cannot under any circumstances be held against Mes Fleurs, nor constitute a cause for termination of the contract, nor give right to any compensation for damages.

Order Conformity

All Mes Fleurs products are covered by the statutory warranty of conformity (Articles L. 217-3 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

Upon receipt of the package, the Customer is responsible for verifying the conformity of the items. Any issues regarding damaged outer packaging or missing products must be reported to the carrier immediately; it is recommended to refuse delivery of a damaged package.

In principle, a customer in France has a right of withdrawal applicable to distance sales (excluding custom-made creations). They have a period of 14 days from the date of delivery to return the ordered product for an exchange or refund.

Please note that, in order to keep the flowers in a condition suitable for resale, refunds will only be issued after the items have been physically received at our premises and have passed a quality check, provided they are returned in their original packaging. The customer will be refunded for the order (excluding delivery costs) within 14 days of the package being received at our premises. 

Any errors or omissions regarding the order must be reported to customer service at contact@mesfleursfr.com upon receipt so that we can assist you. To ensure faster processing of your request, we recommend attaching the original purchase invoice. Products that have been altered or modified are not covered.

In the event of delivery failure or failure by the Customer to collect the parcel, the order cannot be reshipped. The Customer will be refunded for the order (excluding delivery costs) within 14 days of the parcel being received at our premises.

Liability

Mes Fleurs accepts no liability regarding the use made of the items offered for sale. The products sold are not edible and must be kept out of the reach of children or animals.

Mes Fleurs also accepts no liability for Site disruptions, computer errors on the Site, emails sent to incorrect addresses, or any other malfunction or interruption related to the Internet. 

Personal Data Protection

Information collected during the ordering process is necessary for order management and the improvement of our services. It is processed in accordance with our Privacy Policy. In accordance with applicable regulations, the Customer has the right to access, modify, and delete their personal data.

Disputes

These General Terms and Conditions of Sale are drafted in French and governed by French law, subject to any mandatory provisions to the contrary. The courts of Paris shall have exclusive jurisdiction in the event of a dispute. In the event of a dispute, an amicable solution will be sought prior to any legal action.
